The claim that Israel has violated the principle of proportionality -- by killing more Hamas terrorists than the number of Israeli civilians killed by Hamas rockets -- is absurd. First, there is no legal equivalence between the deliberate killing of innocent civilians and the deliberate killings of Hamas combatants. Under the laws of war, any number of combatants can be killed to prevent the killing of even one innocent civilian.
The day you write anything that intelligent, reasoned, and convincing is the day you get published someplace that matters.

Notice how clever Dershowitz is here: "…by killing more HAMAS TERRORISTS than the number of ISRAELI CIVILIANS killed by Hamas rockets…"
So the assumption here is that Israel is just killing terrorists…which, of course, they are not. How many Palestinian civilians have been slaughtered? Women, children, the elderly? (And how many of their family members are now MORE LIKELY to be sympathetic to Hamas?) It's Israel's blatant disregard for innocent life that is prompting outrage. But in Dershowitz World, every Palestinian is "a Hamas terrorist."
I guess this question of collateral damage for the Israelis, especially in a tiny confined space for over a million Arabs like Gaza, is settled: Dresden.
