Trump’s claim of 9/11 celebration in New Jersey is based on arrest of 5 ‘laughing’ Israelis

on 67 Comments

Donald Trump’s nutty/scary claim that he saw thousands of Muslims celebrating the 9/11 attacks in Jersey City has been widely debunked in the media, but few are pointing out the story on which Trump’s claim is likely based: the arrest of five Israeli employees of a moving company who were said to have watched the towers fall from Weehawken, NJ, with jovial expressions.

Trump himself has sought to back up his claim by tweeting a passage from an article in the Washington Post on September 18. That article said:

In Jersey City, within hours of two jetliners’ plowing into the World Trade Center, law enforcement authorities detained and questioned a number of people who were allegedly seen celebrating the attacks and holding tailgate-style parties on rooftops while they watched the devastation on the other side of the river.

Who was detained? Jim Galloway at remembers that it was Israeli employees of a moving company:

They were Israeli and Jewish – young men making asses of themselves, as some young men are wont to do…. apparently laughing, clowning and photographing themselves

Politico has an article that mentions the Washington Post article but doesn’t tell you that the arrested men were Israelis; while Slate downplays the incident as the “strange tale of the dancing Israelis” in a piece on 9/11 legends. It says that story has taken on a life of its own among anti-Semitic conspiracy theorists.

Whether the Israelis were making asses of themselves or whether the story is repeated by conspiracy theorists is irrelevant. But the case was not a strange tale or a legend. The men were held by US authorities for more than two months before they were deported. This ABC News piece months later describes an investigation of suspicious behavior by the men:

Five men were arrested after they were seen filming the attack and apparently celebrating it too…

The driver of the van, Sivan Kurzberg, told the officers, “We are Israeli. We are not your problem. Your problems are our problems. The Palestinians are the problem.” The other passengers were his brother Paul Kurzberg, Yaron Shmuel, Oded Ellner and Omer Marmari.

It was widely thought that the men were spies, ABC said:

Vince Cannistraro, a former chief of operations for counterterrorism with the CIA who is now a consultant for ABCNEWS, said… many people in the U.S. intelligence community believed that some of the men arrested were working for Israeli intelligence. Cannistraro said there was speculation as to whether Urban Moving had been “set up or exploited for the purpose of launching an intelligence operation against radical Islamists in the area, particularly in the New Jersey-New York area.”…

Many U.S. government officials still believe that some of them were on a mission for Israeli intelligence. But the FBI told ABCNEWS, “To date, this investigation has not identified anybody who in this country had pre-knowledge of the events of 9/11.”

This piece published by the Forward (and republished at a WTC-truther site) says the five men were likely Mossad and notes that they were deported to Israel following their release.

According to one former high-ranking American intelligence official, who asked not to be named, the FBI came to the conclusion at the end of its investigation that the five Israelis arrested in New Jersey last September were conducting a Mossad surveillance mission and that their employer, Urban Moving Systems of Weehawken, N.J., served as a front.

After their arrest, the men were held in detention for two-and-a-half months and were deported at the end of November, officially for visa violations.

I’ve heard about the Israeli movers’ story down through the years and never been very interested in it, it’s in s being in a gray zone of unproveable assertions. But the story certainly doesn’t reflect well on Israel; and what is curious here is the media’s reticence about the Israeli movers as the basis of Trump’s lie. The rules just don’t apply when it comes to Israel; Israeli forces can do no wrong in the U.S. Consider: Last month the CIA co-hosted a conference on national security and invited officials from the blessed trinity of Britain, France and Israel. Gosh. If we had a normal relationship with Israel we might see that they have a constitutional problem — millions of Palestinians can’t vote for the Jewish state government that rules their lives — that is hurting the United States across the Middle East. We can’t. Or consider Russia’s response to Turkey’s shoot-down of its plane. BBC reported today that Russia has already begun cutting off the importation of Turkish foods in a semi-official protest of the attack. I thought of Rachel Corrie and Furkan Dogan. Israeli forces killed these charitable American citizens under highly dubious circumstances; and there have never been consequences to Israel for its conduct. We really have no national interest when it comes to Israel; Israel’s interest is our interest. The failure to report the simple facts around Trump’s lie is yet another example.

I’ve heard about the Israeli movers’ story down through the years and never been very interested in it, it’s in s being in a gray zone of unproveable assertions.

    Unprovable assertions?

Grant Smith secured the truth of the matter with a FOIA from the FBI. He published them, and a rebuttal to the Trump claim on, on November 24, 2015.

“Joyous Celebration” during 9/11 World Trade Center Attack

“…five (5) Israeli nationals, detained in conjunction with the TWINBOMB investigation, had videotaped the terrorist attack on the World Trade Center and may have possessed foreknowledge of the same…”

A Youtube compilation of news reports on September 11, 2001 including the woman who first saw the men beneath her apartment building celebrating the downing of the WTC thinking they were ‘Middle Eastern’ (at 4:12), and the East Rutherford NJ cop, Scott deCarlo, (at 4:31) who arrested the Israelis on the turnpike. Don’t miss minute 5:00. These are the returning Israelis explaining on Israeli TV months later, and after they were released from a Brooklyn jail and whisked home, that they had gone to NYC “to document the event”:

You should note that the FBI’s May 3, 2012, 70-page file copy of Wayne Madsen report on “The Israeli Art Students and Movers” (in Grant Smith’s FOIA listing) contains a stunning list of names, identities, and addresses of Israelis involved in spying on the US.

Smith’s FBI document haul total nearly 400 pages of provable “assertions.”

Did Trump inadvertently open a hornet’s nest?

BTW, on the day of–September 11, 2001–I heard the Israeli NJ arrest report on TV where I live. This has never been in dispute as far as I am concerned.

And it has been included in Paul Thompson’s 911 timeline since Day One: Complete 911 Timeline – History Commons

PW’s liberal Zionism is showing. He wants to protect Israel

The truth of the story of the Israeli “art students and movers” is not in doubt in anyway.

And it is very important and very interesting that some part of the Israeli government knew that 911 was coming (at a minimum they knew this — who knows if their involvement went deeper).

Those FBI documents are interesting. I was fascinated to see they documented one of the Israelis’ vital stats as 85 kg and 1.82 “centimeters”. I guess a grand piano must’ve fallen on him.

I ask again, is Trump mis-remembering? or is he goading AIPAC and Sheldon Adelson, who are not supporting his campaign. He also derided his opponent Marco Rubio about Sheldon Adelson grooming him to be a perfect little puppet. He knows about buying politicians. He knows about media. He knows about power and negotiations. He knows finance. He doesn’t need AIPAC’s money, but, if he’s going to win and govern, he will need to have a working relationship with such a media and political power base, which so far is not on his side.

By launching this issue in the wake of the Paris attacks, he may just be another stupid, anti-Muslim racist, or, he may be a very savvy right-wing politician, focused like a laser on winning and then effectively wielding power, showing through indirection that Israel has a lot to lose by alienating a guy like him. It’s like an astute move in chess, opening up multiple lines of attack with a single move. He’s feeding the right-wing mob raw, anti-Muslim, anti-immigrant red meat, while subtly warning Netanyahu through AIPAC not to get in his way, not to dismiss him, not to oppose him, not to think that he will toady to them as Obama does, but someone potentially worth dealing with on his terms.

Dismissing him as stupid is pretty dangerous, especially given his past membership in the Democratic Party, suggesting that his right-wing appeals may just be politics to win in the primary.

The politics of the right-wing is very dangerous, but then, the current Israeli government has very clearly adopted that path, and will not stop in its drive toward catastrophe until forced from power.

David, how do you think his daughter’s orthodox Jewish religion (adopted) figures into this? Ironic that it was her husband who fired Phil from The New York Observer for not being Zionist enough. Her husband applied to Harvard and couldn’t get in because he wasn’t smart enough, until Daddy made a donation . . . that was before Daddy went to jail for four years.

    • pabelmont on November 26, 2015, 3:24 pm

Interesting to compare Trump, now, to Obama, now. Neither, it seems, needs AIPAC money for personal elective purposes. But Obama acts as if he needs it. Is this because he will not cut loose from the other Dems and wants them (Hillary) to be elected? Is it to secure post-2017 speaking gigs? Money for presidential library? Strange.

    • kalithea on November 26, 2015, 6:04 pm

So if information gathered on the Israeli spy ring is classified; then if Trump becomes President he can threaten to declassify the results of the FBIs investigation if AIPAC doesn’t back him up. If anyone knows how powerful Zionists are and can air some of their dirty laundry it would be Trump since in his business and social circles he must bump into powerful Zionists all the time.

      hi David,
i think you are giving to much credit to Trump. yeah when it comes to amassing large sums of money he’s in his element but where politics is concern he’s dumb. he’s not able to master the art of lying like most politicians.
i see people comparing him to hitler or mussolini but i see him more as a Henry Ford.
maybe the media is giving Trump enough rope to hang himself and then we will have our
“Henry Ford v’s Chicago Tribune” day.

    • inbound39 on November 27, 2015, 6:50 pm

Trump can in no way be seen as stupid. Look at his empire….not the result of being stupid. Having said that we need to look at the damage the likes of AIPAC and other pro Israeli groups have done to the Political Stage in America. This election the contenders are a motley crew of Hasbarists and clowns. Some show their traitorous intent openly knowing they are untouchable. I have not yet seen one real and genuine contender interested in representing the interests of the American people….not one. The Israeli Lobby has reduced America’s Political System to a mockery of what it should stand for. Worldwide people stand looking stunned at the state of American politics. Many people I speak to cannot understand how America can stand alongside such a criminal State as Israel and seriously defend it. Look at the cost to America’s integrity and standing around the globe. America these days has little credibility and all of this has been created with meddling from Israel. It’s money and politicians like Netanyahu and Livni and Barak. It genuinely stuns me that Americans have allowed this to happen and I live in hope that they will at some point make a solid stand and eject these people from their political interference.

RE: “I’ve heard about the Israeli movers’ story down through the years and never been very interested in it, it’s in s being in a gray zone of unproveable assertions.”

MY COMMENT: If memory serves me correctly, a woman in New Jersey said she felt her apartment shake and she looked out the window to see what was going on. She saw these guys on the top of their Urban Moving van (in Liberty State Park) celebrating and videotaping in the direction of the twin towers across the bay.
AS I RECALL IT, according to her, the shake/vibration she felt was from the first plane hitting the twin towers, and she immediately went to her window , so the guys with Urban Moving were apparently waiting (ready to film/videotape) for the first plane to hit.
So, the question is not about a “conspiracy”, but is about whether the Israelis were surveilling the terrorists (mostly Saudis) who carried out the 9/11 attacks, and how much they knew about what the (mostly Saudi) terrorists were up to.
Personally, I have no way of knowing. It is possible that any Mossad agents or other Israeli spies who were in the U.S. (whether working at Urban Movers in NJ or working/living elsewhere) had no advance knowledge of 9/11, and were instead involved in unrelated, mundane activities. I simply do not know.

The Five Dancing Israelis – 9/11/2001 – “Our Purpose Was To Document The Event”

    • JLewisDickerson on November 26, 2015, 2:47 pm

P.S. In the event the woman in New Jersey who said she felt her apartment shake/vibrate actually was feeling the impact of the second plane crash into the Twin Towers (and somehow missed feeling the impact of the first plane), that would give the Urban Moving guys about 17 minutes* from the first impact to have heard about the first plane hitting the Twin Towers, travel to Liberty State Park and get set up before the second plane hit.

      * FROM WIKIPEDIA (Timeline for the day of the September 11 attacks):

8:46:30:[10] Flight 11 crashes at roughly 466 mph (790 km/h or 219m/s or 425 knots) into the north face of the North Tower (1 WTC) of the World Trade Center, between floors 93 and 99. (Many early accounts gave times between 8:45 and 8:50.)

9:03:02: Flight 175 crashes at about 590 mph (950 km/h, 264 m/s or 513 knots) into the south face of the South Tower (2 WTC) of the World Trade Center, between floors 77 and 85.[18]

      • Marnie on November 28, 2015, 1:44 am

Interesting these 4 israeli spies were on future MK/head of Yesh Atid party, Yair Lapid’s talk show, claiming they were there to document event. They had at the least prior knowledge of the “event”. Cold-blooded bastards observing tragedies as they happen or accomplices to the “event”. When the Boston marathon bombing occurred, there was an israeli there, who reported to israeli newspapers that the Americans were running all over the place, disorganized, etc., but as israelis “we understand”. Always sickened by the israeli redirect to divert the attention on any tragedy to themselves – 9/11, Boston marathon, and most recently France.

ALSO SEE: “Were Israelis Detained on Sept. 11 Spies?”,

[EXCERPTS] . . . Despite the denials, sources tell ABCNEWS there is still debate within the FBI over whether or not the young men were spies. Many U.S. government officials still believe that some of them were on a mission for Israeli intelligence. But the FBI told ABCNEWS, “To date, this investigation has not identified anybody who in this country had pre-knowledge of the events of 9/11.”

Sources also said that even if the men were spies, there is no evidence to conclude they had advance knowledge of the terrorist attacks on Sept. 11. The investigation, at the end of the day, after all the polygraphs, all of the field work, all the cross-checking, the intelligence work, concluded that they probably did not have advance knowledge of 9/11,” Cannistraro noted.

As to what they were doing on the van, they say they read about the attack on the Internet, couldn’t see it from their offices and went to the parking lot for a better view. But no one has been able to find a good explanation for why they may have been smiling with the towers of the World Trade Center burning in the background. Both the lawyers for the young men and the Israeli Embassy chalk it up to immature conduct. . .

Nothing like gray zones of unproveable assertions and muddy black zones of censorships, redactions, silences, and unfalsifiable claims, where the imperial subject can suddenly lose memory, fall into a momentary irresolution, and cross on to the other boat!

As for my own part I don’t find that the ‘gray zone’ of the Dancing Israelis is particularly gray, or particularly uninteresting.

  7. Boomer on November 26, 2015, 8:00 pm

Interesting. Thanks for the report, and thanks for stating important truth once again about the special status of Israel in U.S. politics and media, which leads us (contrary to our own interests, as well as moral principles) to support the continuing oppression of the Palestinians.

  8. kalithea on November 26, 2015, 8:06 pm

Those happy Israelis didn’t pass the polygraphs. So months before 9/11 a wide-spread Israeli spy ring was conducting espionage operations in the U.S. and they didn’t know 9/11 was going to happen.

So these Israeli movers were there to record something they didn’t know anything about. And they were smiling and hi-fiving each other over a tragedy they supposedly didn’t know was going to happen. And they didn’t know it was going to happen, why? If it was because they didn’t think those Saudis could pull it off, they sure were a little too excited with the outcome!

If it looks like a duck, swims like a duck, and quacks like a duck…it sure isn’t the hippo they pretend our lying eyes see.

So the ADL rushed in to condemn Trump, but maybe Trump was just baiting and predictably they took the bait (methinks they doth protest too much over supposed Arabs celebrating an American tragedy.) So for now, maybe Trump stated Arabs were celebrating 9/11 just to see how skittish Zionists might get that he dared to bring this topic up and test how far AIPAC might jump.

I kinda wish Trump could take this torment a little further with Zionist nervous nellies by threatening to take a peek inside the classified Pandora’s box, I mean banker’s box…marked Israel: Top Secret.

The reputable Israeli daily Ha’aretz reported that by the last week of October 2001, some six weeks after the men had been detained, Deputy Secretary of State Richard Armitage and two unidentified “prominent New York congressmen” were lobbying heavily for their release. According to a source at ABC News close to the 20/20 report, high-profile criminal lawyer Alan Dershowitz also stepped in as a negotiator on behalf of the men to smooth out differences with the U.S. government.

  12. Elisabeth on November 27, 2015, 5:15 pm

I think the quote from that interview by the Israeli talkshow (“our purpose was to record this” or whatever) is not enough to claim that these people knew about the 9/11 attacks beforehand and were there because they knew what was going to happen. It is more likely that they, like many Israeli’s after the recent Paris attacks, feel happy about terrorists targeting western countries because they hope this will make people feel sympathetic towards Israel. When they saw what was happening they celebrated (“let them feel what we poor Israelis have been going through for decades” etc.) and recorded it.
I don’t believe in most conspiracy theories, only some :-).

    • kalithea on November 28, 2015, 9:08 pm

So they detained over 100 Israelis after 9/11 who were part of a spy ring and that detail means nothing, right?

So even if you wanna be naïve; at least admit it’s sick to rejoice over terrorists targeting Western countries and people forced to jump out of skyscrapers to their certain death.

When Zionists insisted on barging into that neighborhood; they knew perfectly well what they were about to unleash and today they still care squat about the consequences to everyone else!

      • Elisabeth on November 29, 2015, 5:40 am

I am sure there are many more Israeli spies in the US at any time than just 100. Whether they knew in advane of 9/11 is a different matter.

“…at least admit it’s sick to rejoice over terrorists targeting Western countries et…”

Where on earth does this reaction come from?
The Israeli gloating over 9/11 and more recently Paris makes me sick. Israeli’s of Dutch descent even send in letters to Dutch newspapers saying : “We have been living with security checks around public buldings for decades. Good luck with your new reality and maybe you finally understand what it is like for us”.
Except that we don’t live in a robber state which routinely desposseses and kills people at will.

Why do you assume I would find this rejoicing NOT sick?

Those security checkpoints in Holland, and at airports in the U.S., are all because of Israel’s so-called “War on Terror”, manufactured by international corporate war profiteers. THAT is “who benefits” from these attacks.

  13. lonely rico on November 27, 2015, 8:31 pm

I thought of Rachel Corrie and Furkan Dogan. Israeli forces killed these charitable American citizens under highly dubious circumstances; and there have never been consequences to Israel for its conduct.
Corrie and Dogan, true American heroes,
their sacrifice erased from US history.
Also erased, the USS Liberty, 34 USN sailors “deep sixed” in the interest of the only racist democracy in the ME.
Consequences for Israel ? Oh yeah ! More weapons ! Massive quantities of weapons, used again and again against some of the poorest and most vulnerable people in the world. Diplomatic cover and protection to allow Israel to ignore its responsibilities and duties as a member state of the UN.
Consequences for the USA ? Involvement in multiple military mis-adventures in the ME, involving huge cost and loss of American (and other) lives – the US now the most hated country in the world (along with Israel), whereas in 1945 it was the most admired.
    It’s the Zionist way

Their “celebration” was not some kind of testosterone-fueled horseplay. They flicked their lighters with the burning towers as a backdrop. They laughed and celebrated. Sorry, I can’t find the source for the “high fives,” but it’s out there. “Reportedly they had worn Palestinian or Arab garb which was later found in the van.” (“Solving 9-11; The Deception That Changed The World.”)
from the same source: “The Israeli agents, who were caught with multiple passports, box cutters, and thousands of dollars stuffed into their socks, were driving a van that tested positive for explosives when they were arrested.”
Your skillful white-gloves treatment of the event obfuscates more than clariifies the small role these criminals played on that terrible day that forever changed our country–and ignited the conflagration that is now the mid-East. As the great Dr. Judy Wood says, “It was an attack on human consciousness.” We couldn’t go into Iraq without the reactionary hatred of Islam, which a growing number of people around the world now know was based on the false premises promoted by the official narrative of the WTC & Pentagon events.

Thank you for your comments. It seems to me “staunchly pro-Israel” people come in two types. One group are conventionally decent people, but are woefully uninformed. They may also be in deep denial, because even hints of certain facts are too painful to look at. They are like the mother who can’t bear to consider the evidence that her son is a criminal. The second group sees Palestinians as vermin to be eradicated, less than fully human. These are the ethnic supremacists, like slaveowners. They are the most intransigent.

But the facts will not be denied in the internet age. The old power brokers cannot bury the truth like they once could. Truth leaks are all over the place. A person can either commit themselves to objectivity and universal human rights, or resist the tide by clinging to emotional fantasies. The more tenaciously they cling, the more shock and destruction they will experience when the truth rolls over them.

Yes, how very interesting to see the obvious effort by US news media to conceal the fact Israeli Jews were observed celebrating the “9/11” attacks on the World Trade Center.

    • Kathleen on December 1, 2015, 10:30 am

Not a peep on any outlet I am listening to. CNN, FOX, MSNBC…although readily saying Palestinians were celebrating and they never say “some”

Posted the ABC story about the Israeli movers at Maddow’s, Hayes, Matthews, Trumps fb pages about five days ago. Either Trump is purposely trying to bring attention to this or he just happened to trip over it.

On Morning Joe last week Tom Brokaw brought this story up but was basically poling fun.

  18. JWalters on November 28, 2015, 5:01 pm

Cover-ups of brutal killings do sometimes happen, and by people in positions of high authority. People who indignantly sneer at such possibilities, especially without addressing the evidence, are usually either duped or part of the cover-up.

For example, we’ve just learned from newly released video showing the shooting death of Laquan McDonald that the Chicago police department covered up a clear murder by a police officer for over a year. The video completely contradicts the official story, and supports non-police witnesses to the murder. The video was only released after a tip led to a Freedom of Information filing.

In addition to the group of Israelis sent to “document the event” while disguised as moving company employees, many other Israelis were arrested. One group was approaching the George Washington bridge with a van full of explosives. And there was another van, with a paintiing on its side of a plane heading into a Trade Center tower, which was blown up.

Oddly, these facts were all omitted from the Bush administration’s official report on 9/11.

Also omitted from the Bush-Cheney official report was any mention of the third building that collapsed that day, Building 7 of the World Trade Center. By even the most simple standards of investigation and reporting, omitting all discussion of one of three buildings that collapsed as a result of the attack boggles the mind.

Due to outside pressure, the Bush-Cheney administration finally did an investigation of Building 7, and released it in the last days of their administration. Notably omitted was any investigation into the numerous explosions preceding all three collapses, which were reported by many witnesses, including firemen and police officers, and reported by some local TV news reporters, whose footage is still available.

The Bush-Cheney administration had a pattern of interfering in scientific and technical reports to suit their agenda, documented in The Republican War on Science. Regarding Bush-Cheney plans to attack Iraq, the famous Downing Street Memo by the head of MI6 told how “facts were being fixed around the policy”, i.e. evidence was being falsified to justify actions.

So covering up Israelis filming the Twin Towers’ collapse and high-fiving would be nothing new. But it INEVITABLY raises the question in any rational mind – What else is being covered up?

    • JWalters on November 28, 2015, 5:23 pm

What might an honest, professional report on the collapse of Building 7 have said?

The Bush-Cheney report’s omitted evidence about Building 7 is discussed by architect Richard Gage in this excellent interview on C-SPAN.

      • Kathleen on December 1, 2015, 10:29 am

Now with the documentary SpyMasters out the CIA’s efforts to warn the Bush administration (Condi Rice/Stephen Hadley) that there were imminent threats by Al Qeada that were close on the horizon. Their clear warning of an imminent attack parallel with counter terrorism expert Richard Clarke’s efforts to warn the Bush administration of Al Qeada using planes to attack.

Bush administration clearly chose to be asleep at the nations wheel.

      “Twin Towers’ collapse”

I’m with you. I have refused to go into any steel-and-concrete or steel frame skyscraper since 911. Obviously there has been massive fraud in the architectural, construction and building insurance industry in the US.

    • Eva Smagacz on November 30, 2015, 3:45 pm

      I understand your fear, Moser!

Especially taking into the account the building codes have not been changed despite the collapse of building 7.

On a separate note I remember reading this article, and it states perfectly adequately, as far as I’m concerned, why building 7, despite collapsing so mysteriously, has not provoked any worries about weakness in the commonly used methods, materials and techniques in building of sky rises in the western world.

      SEC & EEOC:
      Attack Delays Investigations

      By Margaret Cronin Fisk
      National Law Journal
      September 17, 2001

Additional details emerged Friday about the effect of the collapse of 7 World Trade Center on investigations being conducted by the New York offices of the Securities and Exchange Commission and the Equal Employment Opportunity Commission, both of which were housed in the building.

The SEC has not quantified the number of active cases in which substantial files were destroyed. Reuters news service and the Los Angeles Times published reports estimating them at 3,000 to 4,000. They include the agency’s major inquiry into the manner in which investment banks divvied up hot shares of initial public offerings during the high-tech boom.

The EEOC said documents from about 45 active cases were missing and could not be easily retrieved from any backup system. One of these cases was a sexual harassment charge filed on Sept. 10 against Morgan Stanley, one of the prime corporate victims of the World Trade Center disaster.

A statement from the commission said that “we are confident that we will not lose any significant investigation or case as a result of the loss of our building in New York. No one whom we have sued or whose conduct we have been investigating should doubt our resolve to continue our pursuit of justice in every such matters.”

But the short-term problems will be immense, said Gregory Joseph of New York’s Law Offices of Gregory Joseph.

“Court papers can largely be reconstituted, but work product has to be reconstructed,” he said. “This will cause delays in court and will require significant reduplication of effort.” Some data, he added, “won’t be recreatable.”

“Ongoing investigations at the New York SEC will be dramatically affected because so much of their work is paper-intensive,” said Max Berger of New York’s Bernstein Litowitz Berger & Grossmann. “This is a disaster for these cases.”

“The SEC will have some difficulty, but the bounce-back will come relatively easily,” predicts Harvey Goldschmid, Dwight professor of law at Columbia University and former general counsel of the SEC. “It will throw things off for a period of time, but most of what’s important can be regained. They will have to reconstruct these documents. But most of this was backed up or in Washington. They’ve lost some transcripts but even they’re available.”

      EEOC Records Destroyed

The EEOC’s New York office, which was housed in 7 World Trade Center, sustained no loss of life. But all the agency’s records were destroyed.

Many of the files are backed up in the computer system, but a substantial number of documents are simply gone, said Spencer Lewis, the EEOC district director. Depositions and notes were not scanned into computers and are lost. With depositions and interviews, the agency will be contacting court reporters “and hoping that they’ve got them so we can reconstruct files,” Lewis said. This covers about 45 active cases, including a recent action against Morgan Stanley.

But employment litigators believe the effect here, too, will be transitory.

“The EEOC is decimated as far as office space goes,” but any problems are “only short-term,” said Michael Weber of the New York office of Littler Mendelson. “They will get back to business.” The agencies will be seeking documents from the private law firms and defendants, Weber notes. “My sense is that we will cooperate,” he noted. “Our goal is not to take advantage of this catastrophe.”

“A lot of their records they’ll have online, so they’ll just reprint them out,” adds Harkins. “The EEOC is in a better position than the SEC, because the SEC has a lot more confidential files.”

Despite reassurances, that most of the SEC cases will continue, (despite loss of confidential files) I understand, but don’t remember the sources, that vast majority of these 3000-4000 cases have been abandoned.

        “I understand your fear, Moser!”

I don’t go up in any building taller than a single-wide. Concrete, steel, feh!. Stuff turns to talcum if you give it a good whack. Falls down at free-fall speed.

Undersize 2x4s, plywood and asbestos shingles, that’s the way to build. Has a structure built like that ever collapsed into powder?

  19. Tom Suarez on November 28, 2015, 8:19 pm

Philip, thank you for bringing this out. That’s what Trump’s claim immediately sounded like, and so I was dumbfounded that the media were not even mentioning the possible … “confusion”.

  20. TwoRedDogs on November 29, 2015, 1:34 am

There was also the story of ‘art students’

“In January 2001, the security branch of the U.S. Drug Enforcement Agency began to receive a number of peculiar reports from DEA field offices across the country. According to the reports, young Israelis claiming to be art students and offering artwork for sale had been attempting to penetrate DEA offices for over a year. The Israelis had also attempted to penetrate the offices of other law enforcement and Department of Defense agencies. Strangest of all, the “students” had visited the homes of numerous DEA officers and other senior federal officials.”

And then of course this story:

“Odigo Says Workers Were Warned of Attack

Odigo, the instant messaging service, says that two of its workers received messages two hours before the Twin Towers attack on September 11 predicting the attack would happen, and the company has been cooperating with Israeli and American law enforcement, including the FBI, in trying to find the original sender of the message predicting the attack.”

  21. Kathleen on December 1, 2015, 10:22 am

MSNBC, CNN, FOX news host all bringing up that Palestinians were celebrating the 9/11 attack. They do not say “some”. They never mention the Israeli’s picked up as a result of people seeing them celebrating the 9/11 attacks.

    • lysias on December 1, 2015, 2:42 pm

The dancing Israelis are unpersons, and their dancing is an unfact.

  22. Kay24 on December 1, 2015, 10:37 am

On CNN right now Bernie Kerik mentions that some “Arabs” celebrating in Patterson NJ, and also just mentioned about “thousands” of Palestinians celebrating (no question where HIS loyalties are) BUT NO MENTION ABOUT THOSE DANCING/CELEBRATING ISRAELIS AT ALL.

  23. Kay24 on December 1, 2015, 10:59 am

The cop who on 9/11 investigated the “dancing Israelis”.

This is highly suspicious, and should be mentioned in the media.

Trump offers NY Post piece to support 9/11 claim:

Donald Trump on Tuesday offered a New York Post opinion piece from 2001 as the latest defense of his claim that “thousands and thousands” of Muslim Americans celebrated the 9/11 attacks.

“Look at the editorial I was just sent from the NY Post on 9/14/01 — 3 days after collapse of WTC. Any apologies?” the Republican presidential candidate tweeted with screenshots of the column.

The opinion piece shown in Trump’s tweet says that Egyptians, Palestinians and Arabs in Paterson, N.J., celebrated when hearing of the terrorist attacks in New York and Washington.

The report also noted that then-New York City Mayor Rudy Giuliani warned citizens against taking out their anger on Arab and Muslim residents in the city.

Giuliani said earlier Tuesday on CNN’s “New Day” that while there were some American Muslims celebrating the attack, Trump is “exaggerating” when he says thousands were cheering.

“We did have some celebrating, that is true,” Giuliani said on the CNN. “We had pockets of celebration some in Queens, some in Brooklyn — 10, 12, 30, 40” people.

Looks like Trump is owed some apologies.

    • oldgeezer on December 1, 2015, 3:05 pm

      Let me be the first.

      Dear donald.

I am sorry you lied when you said thousands of muslims danced and celebrated on 9/11

I am deeply sorry that you lied when you said you witnessed it with your own eyes.

Mostly I am sorry for the oxygen wasted by your being a blowhard.
